Personal Information Collection Statement

Purpose of Collection

The Official Solicitor may make enquiries and collect information from concerning parties, including minor(s), in the course of performing and discharging his statutory duties as prescribed under the Official Solicitor Ordinance (Cap 416), including, among others, acting as guardian ad litem or next friend to any person under a disability or mental capacity in proceedings before any court, representing minors in any proceedings where the Court considers it necessary for the minor to be separately represented and acting as committee of the estate of a mentally incapacitated person.

The provision of your personal data to us is entirely on a voluntary basis.

1. Classes of Transferees

   The personal data provided to or obtained by the Official Solicitor are mainly for court proceedings and therefore may be disclosed to the Court and other parties in the proceedings or to other Government Departments, Hospital Authority or relevant persons for the purpose mentioned above if necessary.

2. Access to Personal Data

   You have a right of access and correction with respect to your personal data pursuant to Sections 18, 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance, Cap.486. However, your attention is drawn to the provisions of Section 59 of Cap. 486. Section 59 provides that personal data relating to the physical or mental health of the data subject may not be released if such information is likely to cause serious harm to the physical or mental health of the data subject or any other individual. Your right of access includes the right to obtain a copy of your personal data held by this office.

   When handling a data access or correction request, we will verify your identity to ensure that you are the person legally entitled to make the data access or correction request. A fee is payable by you for the provision of the data requested.
